REGULATIONS SUMMER JAM 2022

§1. [General provisions]

1. These regulations (hereinafter referred to as: “Regulations”) set out the rules of participation in the event Summer Jam 2022 (hereinafter referred to as: the “Event”).
2. The Organizer of the Event is Foundation Supporting #OMGKRK with its registered seat in Kraków (address: Podole Street 60, 30-394 Kraków), entered into the register of associations, other social and professional organizations, foundations and independent public health care institutions as well as the register of entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Department of the National Court Register under the number: 0000602259, identifying itself with REGON number: 363736145 and Tax Identification Number: 9442250193 (hereinafter: the “Organizer”).
3. Contact with the Organizer is possible via the e-mail address: contact@omgkrk.com.
4. All persons taking part in the Event (hereinafter referred to as: the “Participants”) are obliged to accept the Regulations of the Event.

§2. [Registration for the Event]

1. The condition for participation in the Event is registration – using a dedicated application form available online at: https://www.omgkrk.com/summer-jam-2022/ (hereinafter referred to as: the “Form”) or offline at the venue of the Event.
2. Only adults may participate in the Event.
3. Registration for the Event will last until the beginning of the Event or until the limit of Participants, referred to in §3 sec. 3 of the Regulations, is reached.
4. In order to effectively send the Form, you must accept the Regulations and confirm that you have read the privacy policy of the Event, referred to in §5 of the Regulations. The person submitting the Form is responsible for the truthfulness, completeness, timeliness and reliability of the information contained therein.

§3. [Organization and course of the Event]

1. The Event will be held in a stationary form at the following location and date: Forty Kleparz Music Club, Lounge Bar, “Kocie Uszy”, Kamienna St. 2/4, 30-001 Kraków, 30 June 2022, 7 p.m.
2. Participation of the Participant in the Event is free of charge, however the Participant bears all costs related to participation in the Event, including costs of transport, accommodation and meals. The first 250 (two hundred and fifty) Participants present at the Event venue will receive a coupon from the Organizer authorizing them to receive one free drink during the Event.
3. Maximum 400 (four hundred) people can participate in the Event. The Organizer reserves the right to refuse permission to enter the Event area if this would result in exceeding the above-mentioned limit.
4. The Participants shall follow the orders and guidelines of the Organizer and the owner of the Event area, as well as the Police, Fire Brigade, Ambulance Service and other security services issued during the Event in order to maintain safety and order.
5. The Organizer prohibits:
a) entering the Event area under the influence of alcohol or after the use of intoxicants,
b) consuming intoxicants in the Event area,
c) bringing own food, drinks or alcohol to the Event area,
d) littering the Event area,
e) blocking escape routes,
f) smoking tobacco products outside designated places (if such places have been designated at the Event area),
g) disrupting the course of the Event, including creating a threat to other Participants and preventing other people from properly or safely participating in the Event,
h) staying in places that are not designated as the area of the Event,
i) bringing dangerous or prohibited items to the Event area, including:
– weapons and other dangerous items,
– explosives,
– pyrotechnic articles,
– fire-hazardous materials,
– narcotic or psychotropic substances.
6. In the event of a breach by the Participant of any of the provisions of sec. 4-5 above, the Organizer may exclude the Participant from participation in the Event.
7. The Organizer is not responsible for:
a) property brought to the Event area by the Participants,
b) refusal to enter the Event area:
– to persons who are visibly under the influence of intoxicants, psychotropic drugs or other similar drugs,
– to persons who have weapons, pyrotechnics or explosives or other dangerous tools or objects,
– to people behaving aggressively,
– to minors.
8. The Organizer recommends that Participants use individual safety and hygiene measures to reduce the risk of developing Covid-19, as well as follow the official guidelines of the State Sanitary Inspection and the Ministry of Health related to the state of epidemic threat in Poland.
9. The Participant of the Event shall be financially liable for damages caused by him on the Event area, towards other Participants, as well as for damages caused to the property of the Organizer or third parties whose property is on the Event area.
10. Once the Event ends, the Participants may be asked to fill in evaluation questionnaires, used by the Organizer to assess the level of the conducted Event and the level of satisfaction of the Participants.

§4. [Image]

1. During the Event, photos as well as audio and video recordings can be made.
2. Participation in the Event is equivalent to the Participant’s consent for the use of the image recorded in photos and audio and video recordings from the Event in the Organizer’s information, documentation, reporting, promotional, advertising or marketing materials – in accordance with art. 81 of the Act of February 4, 1994 on Copyright and Related Rights and Art. 23 of the Act of 23 April 1964 Civil Code.
3. The Participant’s consent referred to in sec. 2 above: (i) is provided free of charge, without any time or territorial restrictions and (ii) covers multiple use of the Participant’s image, including for promotional purposes of the Organizer and the Event.
4. Using the Participant’s Image includes: (i) recording, processing and reproducing in any way, and (ii) disseminating in whole or in part, in any way and form, including via websites and social media profiles regarding the Organizer and the Event, as well as partners, sponsors, patrons, associates of the Organizer and the Event.
5. The consent referred to in sec. 2 above may be denounced by the Participant with a 12-month notice period, effective at the end of the calendar year. If the Participant withdraws the consent, the Organizer will not be obliged to remove from the public circulation the copies already placed on the market containing the recorded image of the Participant.
6. The Organizer undertakes not to use the image of the Participant in a way or in the context that violates his reputation.

§5. [Personal data protection]

The rules of the protection by the Organizer of the Event Participants’ personal data are described in the privacy policy available at: https://www.omgkrk.com/privacy-policy/.

§6. [Changes or cancellation of the Event]

1. The Organizer has the right to change the date, hours, location and subject of the Event or to cancel it.
2. The Event may be cancelled by the Organizer due to the lack of a sufficient number of Participants or when such a necessity results from the provisions of generally applicable law (e.g. due to the provisions on the prevention of epidemics or on other extraordinary states).
3. In the event of the circumstances referred to in sec. 1 or 2 above, the Organizer will contact the Event Participants without delay.

§7. [Final provisions]

1. In matters not regulated in the Regulations, the relevant provisions of Polish law shall apply.
2. All materials presented and made available by the Organizer during the Event constitute the intellectual property of their authors and are protected by copyright. Preserving, duplicating and disseminating the materials referred to in the preceding sentence without the explicit consent of the Organizer is prohibited.
3. All advertising or promotional materials regarding the Event provided by the Organizer are for information purposes only and do not constitute an offer within the meaning of Article 66 of the Civil Code.
4. To the extent that it is permissible in the light of applicable law, in particular, subject to Article 473 §2 of the Civil Code, the Organizer’s liability for any consequences related to the Participant’s participation in the Event is excluded.
5. Any disputes between the Organizer and the Participant arising from the application of the provisions of the Regulations will be first resolved amicably. If the dispute cannot be resolved in the manner referred to in the preceding sentence, the court competent to settle the dispute will be the court having jurisdiction over the address: Kraków, Rynek Główny 1. The provisions of this section shall not be understood as an arbitration clause.
6. The Organizer reserves the right to amend the Regulations. Amendments to the Regulations come into force on the date indicated by the Organizer, not shorter than 3 (three) days from the date of publication by the Organizer.
7. The Regulations enter into force on May 31, 2022.
